GENERAL TERMS AND CONDITIONS OF SAMBANDHA EV FOR THE BHAKTI BLOOM FESTIVAL
Sambandha e.V., registered at the Neuruppin District Court in the register of associations under the number VR 5593, (hereinafter: Organiser) organises the Bhakti Bloom Festival (hereinafter: Festival).
The following General Terms and Conditions (GTC) and the Festival Regulations apply to the legal relationship between the Organiser and natural persons who have purchased a ticket for the Festival (Purchaser) or acquired it from the Organiser in any other way. By purchasing a ticket, the purchaser (festival visitor) accepts the following GTC.
I. Purchase contract

The purchase of the ticket takes place exclusively via the listing of the festival on tickettailor.com and requires the submission of a binding offer by the purchaser.

The binding offer to conclude a contract on the part of the buyer is made by correctly entering and sending all the necessary data for payment processing and for dispatching the tickets and by clicking the ‘Pay’ button at the end of the order process.

Following the order process, the buyer receives an automatically generated e-mail from bhaktibloomfest@buytickets.at in which the receipt of the contract offer is confirmed. This e-mail only documents the receipt of the contract offer. It does not constitute a binding declaration of acceptance by the organiser.

The purchase contract only comes into effect through the submission of a declaration of acceptance by the organiser, which the organiser confirms in a separate email after receipt of a contract offer within the meaning of Clause 1.3.

The purchase contract is subject to the resolutory condition that the amount owed for the handover and transfer of ownership of the ticket is not received by the Organiser in due time or in full within the meaning of Section 2.2.

Except in the case of § 313 para. 1 BGB, the purchaser has no claim to a subsequent adjustment of the contract. However, subsequent requests for changes or corrections can be communicated to the email address info@bhaktibloom.de.

The buyer has no right to cancel the purchase contract. In particular, a right of cancellation does not arise from § 312g para. 2 no. 9 BGB.

The purchase of tickets for the purpose of resale is strictly prohibited. Offences against this and attempts at fraud of any kind will be prosecuted in any case.
II Purchase price and payment

The prices offered for the tickets are total prices including the advance booking fee and the applicable VAT. Additional charges may be incurred for payments not made by bank transfer, direct debit or cash. In the case of bank transfers from abroad, the purchaser is responsible for all transfer fees.

The total price must be credited to the organiser's account without deductions no later than 14 days after receipt of the declaration of acceptance.
III Cancellation and cancellation of the festival

The festival may be cancelled by the organiser in advance for objectively justified reasons. Objectively justified reasons include, in particular, if too few tickets have been sold or if team members are cancelled at short notice.

If the festival is cancelled in advance by the organiser within the meaning of section 3.1, the purchaser may reclaim the purchase price paid within the meaning of section 2 from the organiser within 6 weeks.

The festival can also be cancelled by the organiser at any time in advance or discontinued after the start if it cannot be held due to a court or official order or due to force majeure (weather, terrorist threat, etc.).

If the festival is cancelled or interrupted by the organiser within the meaning of section 3.3, the purchaser has no claim to compensation or reimbursement unless the cancellation or interruption is due to intent or gross negligence on the part of the organiser, its legal representatives or its vicarious agents, or, in the case of simple negligence, due to the breach of a material contractual obligation. Essential contractual obligations are those obligations whose fulfilment is essential for the proper execution of the contract, whose breach jeopardises the achievement of the purpose of the contract and on whose compliance the contractual partner regularly relies.

In the event of a breach of material contractual obligations due to simple negligence, liability shall be limited to the damage that the organiser foresaw as a possible consequence of the breach of contract when the contract was concluded or should have foreseen, taking into account the circumstances that it knew or should have known.

Sections 3.4 and 3.5 do not apply to claims for damages arising from injury to life, limb or health.
IV. Access to the festival site

First-time access to the festival site is only possible on presentation of the tickets purchased in accordance with Sections 1 and 2 or otherwise received from the organiser and only at the points of entry issued by the organiser.

Upon presentation of the ticket, the festival visitor receives a festival wristband. Only festival wristbands issued by the organiser are permitted on the festival site. Persons who remain on the festival site without a festival wristband issued by the organiser will be immediately expelled from the festival site. After leaving the festival site for the first time, re-entry to the festival site is only possible upon presentation of the festival wristband.
V. Stay on the festival site

The instructions of the organiser or persons authorised by the organiser must be followed on the festival site.

The bringing of glassware, drinks cans, sharp, bulky, dangerous and pyrotechnic objects and weapons is generally prohibited. Fires may only be lit in the areas designated by the organiser. Festival visitors are responsible for ensuring that they do not cause a fire hazard on the festival site (e.g. by leaving behind or throwing away smouldering objects).

Non-alcoholic drinks in plastic containers are permitted in small quantities of up to 2 litres. Smoking and the consumption of alcohol are prohibited on the festival site without exception.

Waste must be disposed of in the bins provided throughout the festival site. In particular, festival visitors must ensure that they dismantle their campsite completely on departure and leave it litter-free.

Motor vehicles may only be parked on the festival site as instructed by the organiser or persons authorised by the organiser. Escape routes must be kept clear. Vehicles parked illegally in this sense will be towed away for a fee. For reasons of space and for the good of the environment, travelling to the festival site should be done by public transport if possible.

Camping on the festival site is only permitted in the designated areas. Caravans are only permitted on the designated caravan sites. Tent and caravan pitches can be reserved when booking tickets.

Dogs must be kept on a lead throughout the festival site. However, festival visitors are requested not to bring their dogs onto the festival site if possible.

Festival visitors are asked to leave the festival site as clean as possible and to respect the property of others. Where possible, only cosmetics and toiletries that are fully biodegradable should be used on the festival site. Every festival visitor is required to use the festival site in an environmentally conscious manner.

The utterance of offensive, sexist, racist, anti-constitutional and recognisably unlawful statements and the wearing of clothing and badges with offensive, sexist, racist, anti-constitutional and recognisably unlawful statements and symbols, including symbols and recognisable references to anti-constitutional organisations, as well as the display and carrying of corresponding posters, banners, flags and the like is prohibited.

The festival site is closed from 11 pm to 8 am.

In the event of a breach of the aforementioned regulations, the festival visitor in question may be expelled from the festival site for the remainder of the festival.
VI. Programme design

The responsibility for the content of the music programme lies exclusively with the respective artists.

The organiser reserves the right to change the entire programme (including admission times and programme schedule) at any time without prior notice. However, changes will always be made in accordance with the concept of the festival as advertised by the organiser on its website.

The contents do not reflect the opinion of the organiser, its legal representatives, vicarious agents or assistants.
-
Sound, image and film recordings are only permitted for private use and in compliance with the personal rights of other persons.
-
Sound, image and film recordings for commercial purposes and/or for public media (radio, television, internet) are strictly prohibited without the organiser's consent.
-
In the event of a breach of the aforementioned provisions, the festival visitor concerned may be expelled from the festival grounds for the remainder of the festival.

The organiser reserves the right to take legal action, including criminal prosecution, in the event of a breach of the aforementioned provisions.

Visitors grant the organiser the right to be photographed and/or filmed. The visitor agrees that this material may be made publicly accessible. The visitor has no claim to the image rights to recordings that are photographed or filmed by the organiser or its agents in connection with the event and in which the visitor can be recognised.
VIII. Protection of minors

Children and young people under the age of 14 may be denied access to the festival site if they are not accompanied by a parent or guardian. Parents are responsible for their children on the entire festival site.

In all other respects, the statutory provisions of the Youth Protection Act apply.
IX. Liability

The organiser is not liable for items lost or stolen during the event.

The festival takes place primarily outdoors and in tents and is therefore subject to the influence of the weather. Festival visitors are responsible for ensuring that they are dressed and housed appropriately for the weather conditions. The organiser expressly does not undertake to provide accommodation and catering for festival visitors.

During the programme performances there is a risk of hearing damage due to the volume. Festival visitors are responsible for providing suitable hearing protection. Furthermore, festival visitors must ensure that they keep an appropriate distance from loudspeakers at all times.

Unless otherwise agreed in these GTC, the organiser shall not be liable for any damage incurred by the festival visitor during the performance of this contract. This does not apply to damages incurred by the festival visitor due to intent or gross negligence on the part of the organiser, its legal representatives or its vicarious agents, or, in the case of simple negligence, due to the breach of a material contractual obligation. Essential contractual obligations are those obligations whose fulfilment is essential for the proper execution of the contract, whose breach jeopardises the achievement of the purpose of the contract and on whose compliance the contractual partner regularly relies.

XI. Contact and dispute resolution

The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a contact point for the out-of-court settlement of consumer disputes concerning contractual obligations arising from online purchase contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. The Organiser is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
XII. Final provisions

The provisions of this contract are final. There are no verbal collateral agreements.

Should individual provisions of the contract be or become invalid or unenforceable, the remainder of the contract shall remain valid.

The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
